1. About Flicker Club
Flicker Club is a non-commercial, community-driven film screening initiative based in Berlin, Germany. We organize free cultural events featuring independent films, documentaries, and experimental cinema. By registering for our events, you agree to these terms and conditions.
2. Event Registration
2.1 Waitlist and Approval
Registration for Flicker Club events is managed through a waitlist system. Submitting a registration does not guarantee attendance. Event organizers review applications and approve attendees based on capacity and community guidelines.
2.2 Invitation
If your application is approved, you will receive an email invitation with event details, location, and check-in information. This invitation is personal and non-transferable.
2.3 Attendance
Attendance is free of charge. We operate on a non-commercial basis and do not sell tickets or charge admission fees.
3. Event Rules
3.1 Punctuality
Please arrive on time. We operate a strict "no late entry" policy to avoid disrupting the screening and other attendees. Doors close at the published start time.
3.2 Respectful Behavior
Flicker Club is a community space. We expect all attendees to:
- Treat fellow attendees, organizers, and filmmakers with respect
- Remain silent during screenings
- Turn off mobile devices or set them to silent mode
- Refrain from photography or recording during screenings unless explicitly permitted
- Follow venue rules and safety guidelines
3.3 Right to Refuse Entry
We reserve the right to refuse entry or remove attendees who violate these terms, behave disruptively, or make others feel unsafe or uncomfortable.
4. Cancellations and Changes
4.1 Event Cancellations
We reserve the right to cancel, postpone, or modify events due to unforeseen circumstances (venue issues, filmmaker availability, force majeure, etc.). Registered attendees will be notified via email as soon as possible.
4.2 Attendee Cancellations
If you can no longer attend an event you've been invited to, please inform us as soon as possible so we can offer your spot to someone on the waitlist.
5. Intellectual Property
5.1 Screened Works
All films screened at Flicker Club events are shown with the explicit permission of their creators or rights holders. Unauthorized recording, reproduction, or distribution of screened content by audience members is strictly prohibited and may be subject to legal action.
5.2 Event Photography
We may take photographs or videos during events for archival and promotional purposes (social media, website, etc.). By attending, you consent to being photographed or recorded. If you do not wish to be photographed, please inform the organizers at the event.
5.3 Open Call Submissions
Rights, permissions, and data storage terms for filmmakers submitting work through the open call are covered in section 12 (Film Usage, Rights & Data Storage).
6. Liability
6.1 Personal Belongings
Flicker Club and event venues are not responsible for lost, stolen, or damaged personal belongings. Please keep your valuables with you at all times.
6.2 Personal Injury
Attendance at Flicker Club events is at your own risk. We are not liable for personal injuries unless caused by our gross negligence or willful misconduct.
6.3 Limitation of Liability
As a non-commercial initiative, our liability is limited to the extent permitted by German law. We are not liable for indirect or consequential damages.
7. Data Protection
We process your personal data in accordance with GDPR and German data protection laws. For detailed information, please see our Privacy Policy.
8. Age Restriction
Flicker Club events are intended for adults (18+). Some screenings may contain mature content. Age restrictions for specific events will be communicated in advance.
9. Community Guidelines
Flicker Club is committed to creating an inclusive, safe, and welcoming environment. We do not tolerate:
- Harassment, discrimination, or hate speech of any kind
- Aggressive, threatening, or intimidating behavior
- Unwanted physical contact or sexual advances
- Disruptive behavior that interferes with others' enjoyment
Violations may result in immediate removal from the event and exclusion from future Flicker Club activities.
10. Changes to Terms
We reserve the right to modify these terms and conditions at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services after changes constitutes acceptance of the new terms.
11. Governing Law
These terms and conditions are governed by the laws of the Federal Republic of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts in Berlin, Germany.
12. Film Usage, Rights & Data Storage
This section applies specifically to filmmakers and rights holders submitting work through the Flicker Club open call.
12.1 Open Call Submissions
By submitting a work to Flicker Club, the submitter confirms that they hold the necessary rights, permissions, or authorisations required to allow the public screening of the submitted material by Flicker Club.
Submitted materials may include:
- film files, trailers, stills, posters, synopses, subtitles, credits, press materials, biographies, contact information, and related metadata.
Flicker Club does not claim ownership of submitted works. All copyrights and intellectual property rights remain with the original rights holders.
12.2 Legal Basis for Data Processing
Personal data submitted through the Flicker Club open call is processed in accordance with:
- the General Data Protection Regulation (GDPR / DSGVO),
- the German Federal Data Protection Act (Bundesdatenschutzgesetz – BDSG),
- the German Copyright Act (Urheberrechtsgesetz – UrhG),
- and applicable European copyright and media regulations.
The legal basis for processing submitted data is:
- Art. 6(1)(a) GDPR — consent of the submitter,
- and, where applicable, Art. 6(1)(f) GDPR — legitimate interest in maintaining a cultural archive, organising screenings, communicating with filmmakers, and preserving submission history for future curatorial consideration.
Submitted materials are processed exclusively for purposes connected to Flicker Club activities, including:
- screening consideration, curation, internal archival purposes, communication with filmmakers, event organisation, future screening consideration, and promotion of Flicker Club events.
12.3 Data Storage & Archival Retention
In accordance with Art. 5(1)(e) GDPR, Flicker Club stores submitted materials and related data only for as long as necessary for the purposes described above.
As Flicker Club operates as an ongoing cultural and archival initiative, submitted film materials and related information may be retained for an unlimited period for archival purposes, future curatorial consideration, historical documentation, repeat screenings, retrospective programmes, and organisational continuity.
By submitting materials through the open call, the submitter acknowledges and agrees that Flicker Club may retain submitted works and related information unless deletion is explicitly requested.
Submitters may request access to stored personal data, correction of inaccurate information, restriction of processing, or deletion of submitted materials and personal data at any time in accordance with Art. 15, 16, and 17 GDPR. Deletion requests may be submitted via hello@flickerclub.com.
12.4 Future Screenings & Reuse
Flicker Club may consider previously submitted or screened works for future screenings, retrospectives, thematic programmes, exhibitions, or archival events. Where appropriate, Flicker Club may contact the rights holder again regarding additional screenings or updated permissions. However, submission to the open call may also serve as ongoing permission for future non-commercial Flicker Club screenings unless explicitly withdrawn by the submitter.
12.5 Screening Permissions Outside the Open Call
In addition to open call submissions, Flicker Club may screen works obtained through direct filmmaker communication, distributors, archives, galleries, cultural institutions, collectives, public submissions, or other legitimate sources. Whenever reasonably possible, Flicker Club seeks screening permission directly from the relevant rights holder before public presentation.
Screening permissions and usage of submitted works are handled in accordance with applicable provisions of the German Copyright Act (Urheberrechtsgesetz – UrhG) and relevant European copyright regulations.
12.6 Archival, Historical & Publicly Accessible Works
Flicker Club may occasionally present archival, historical, anonymous, orphaned, or publicly accessible works where no identifiable or reachable rights holder can reasonably be determined despite good-faith research efforts. Such presentations are carried out exclusively within a non-commercial cultural, educational, artistic, research, or archival context.
If a legitimate rights holder contacts Flicker Club regarding a presented work, the matter will be reviewed promptly and, where appropriate, the material may be removed from future screenings or promotional materials.
12.7 Promotional Use
Flicker Club may use submitted trailers, stills, posters, titles, excerpts, filmmaker names, and promotional materials for the purpose of promoting Flicker Club screenings and activities through:
- social media, newsletters, printed materials, websites, press communication, and event documentation.
Such use is strictly limited to promotional and informational purposes connected to Flicker Club and does not constitute commercial resale, redistribution, sublicensing, or transfer of ownership rights.
12.8 Internal Access & Security
Submitted materials and personal data are accessible only to individuals involved in the organisation, curation, technical management, or administration of Flicker Club activities. Flicker Club does not sell submitted data or submitted works to third parties. Reasonable technical and organisational measures are taken to protect stored materials and personal data in accordance with Art. 32 GDPR.
